CHAPTER XIV. TRAFFICCHAPTER XIV. TRAFFIC\ARTICLE 17. BICYCLES AND SCOOTERS

This article is adopted pursuant to applicable Kansas law concerning municipal regulation of public safety, traffic, and sidewalk use. The intent is to provide a safe pedestrian corridor in the City’s downtown district.

For purposes of this article:

(a)   Location and Scope. This restriction applies to the sidewalks on both sides of Marshall Avenue between its intersections with Fourth Street and Fifth Street, within the City of Chapman, Kansas.

(b)   Electric-assisted scooter or scooter means a stand-up or seated device powered in whole or in part by an electric motor, designed to transport one person, whether shared or privately owned.

(c)   Bicycle means any device having two or more wheels propelled by human power, consistent with definitions adopted in the City’s Standard Traffic Ordinance or Code.

(d)   Micromobility device means a bicycle or an electric-assisted scooter.

(a)   Prohibition: It shall be unlawful to ride, operate, or propel a bicycle, scooter, or electric-assisted scooter upon the sidewalks located within the 400 block of Marshall Avenue, between its intersections with Fourth and Fifth Street. Persons may walk such devices on the sidewalk if necessary.

(b)   Street and Bikeway Use Permitted: Bicycles and scooters may be operated in the street, bicycle lanes, or other designated routes consistent with applicable law and posted control devices.

(c)   Exemptions: This section does not apply to:

(1)   Devices used by persons with disabilities as mobility aids; or

(2)   City, police, or emergency personnel performing official duties.

(d)   Parking and Placement: Micromobility devices shall not be parked or placed in a manner that blocks or obstructs pedestrian passage, curb ramps, doorways, fire hydrants, or driveways. The City Administrator or designee may designate bicycle or scooter parking areas within or adjacent to the block.

The City Administrator or designee shall cause the installation of “No Scooter or Bicycle Riding on Sidewalk” signage at or near each corner of the intersections of Fourth Street and Marshall Avenue and Fifth Street and Marshall Avenue to mark the restricted zone. Violations shall constitute a municipal infraction, punishable as provided by the City’s adopted fine schedule, or, if none, under the general penalty provisions of the City Code. The restriction shall become enforceable upon the installation of signage.
