(a) It shall be unlawful for any dog owner to violate any of the following regulations regarding the use of the Chapman Municipal Dog Park:
(1) Entrance within the dog park between the hours of 9:00 p.m. and 7:00 a.m. or when otherwise closed is prohibited. No animals other than dogs may be brought into the dog park.
(2) Owners shall immediately close and secure the gate upon entering or exiting the confines of the dog park's fenced enclosure.
(3) All dogs that enter the park must be registered with the City of Chapman and have a visible registration tag. All dogs are required to have proof of current rabies vaccination.
(4) Aggressive, vicious, or contagious dogs are prohibited from entering the dog park. Dogs may not be brought into the park if they are sick or unhealthy, have a history of aggressiveness, or have been adjudicated as a vicious or dangerous dog in this or any other jurisdiction historically.
(5) All dogs must be leashed when entering or leaving the dog park's fenced enclosure. Dogs must never be left unattended. The dog owner must be in reasonable control of his/her dog(s) at all times and have a leash available for each dog at all times.
(6) Owners must be at least 18 years of age. Owners must remain within the dog park's fenced enclosure while their dog is in the dog park. Owners are limited to three dogs per visit.
(7) Owners must promptly pick-up and dispose of their dogs' waste at designated receptacles and have done so before leaving the park.
(8) Owners will not allow dogs to dig holes in the park or damage park property. Owners are responsible for immediately filling any holes created by their dog(s) and costs of repair to any park property damaged by the Owners' dogs.
(9) No alcoholic beverages, food (pet or owner), or glass containers are allowed in the dog park area. Smoking is prohibited inside the dog park and within 10 feet of the dog park's parameter.
(10) All dog bites, attacks, or menacing must be reported to law enforcement.
(11) The City Administrator or designee reserves the right to close the dog park for maintenance and repair, public safety reasons, or for special events.
(b) It is unlawful for any person to:
(1) Enter or remain in the dog park at such time as the dog park is closed to the public as set out herein or at such time provided under the rules and regulations adopted by the Governing Body.
(2) Fail to immediately leash and restrain a dog in the dog park when advised to do so by a member of law enforcement, the City Administrator or designee.
(3) Fail to immediately leave the dog park when ordered by a member of law enforcement, the City Administrator or designee.
(c) Owners assume all risks, loss or injury for themselves or their dog(s) associated with or resulting from the use of the dog park. Owners making use of the dog park shall be responsible for injuries caused by their dog(s) to other persons or dogs. Persons using the dog park shall hold the City of Chapman harmless for any damages or injuries resulting from the use of the dog park.
(d) Violators of dog park rules and regulations may be subject to one or more of the following:
(1) Removal from the dog park;
(2) Suspension of dog park privileges;
(3) Issuance of a Criminal Complaint or Notice to Appear.
(e) The City Administrator or designee shall promulgate additional regulations as are necessary to address health and safety concerns related to the operation of the dog park.
